Analisis Kritis Pencatatan Perkawinan

Abstrak

Registration of marriages is the collection of data on a relationship between two people, namely a man and a woman. Registration of marriages is very necessary to ensure legal protection for the wife. The colonial government did not interfere too much with applicable marriage laws. At that time several marriages emerged, namely traditional marriages which were religious, cash, and concrete in character. Then there were also Islamic marriages. guardian and two witnesses. Enacted on January 2, 1974. This law was born due to an idea, namely legal unification and legal renewal. Registration of marriages is very necessary for parties who are married as a basis for state protection for parties to marriage. 

Marriage registration is very necessary because it protects rights and guarantees legal certainty. The conditions for registering marriages can be placed in two contexts, namely preventing and protecting women and children from marriages that are carried out irresponsibly. Marriage registration is one of the principles in the Marriage Law, the implementation of which is regulated in Government Regulation Number 9 of 1975. The realization of marriage registration is evidenced by a marriage certificate, copies of which are owned by the husband and wife. 

The marriage certificate is proof of marriage and also has the benefit of legal guarantees. Marriage registration is very necessary, if the marriage is not legalized then the marriage is not legal according to the law in force in a country. In a philosophical context, marriage registration symbolizes social ties, justice and equality, responsibility, human and spiritual survival. Therefore, marriage registration must be done with full awareness and sincerity to live life together with their spouse. In the sociological sense, the community must be a witness or know that the couple is married and registered in the state so as not to cause slander. 

The religious meaning itself in religion must fulfill its rights, many fiqh scholars say that a marriage can complement maslahah mursalah. The juridical meaning in registering a marriage is an act of legal registration as well as a legal event that contains sacred values by the provisions of religious law and determines the validity of the marriage. Registration of marriages is very important, because with the registration of marriages legal certainty is obtained for both the husband and wife and for their future children. 

And if there is a problem in the household such as divorce, it can be processed legally and can fulfill rights rights that will be obtained by both parties. And also children from the marriage get lineage and can get inheritance rights.

Pencatatan perkawinan merupakan pengumpulan data suatu hubungan antara dua orang, yaitu laki-laki dan perempuan.Pencatatan perkawinan sangat perlu dilakukan agar terjaminnya perlindungan hukum bagi suai istri. Pemerintah colonial tidak terlalu mencampuri hukum perkawinan yang berlaku.

Di masa itu timbul beberapa perkawinan yaitu perkawinan adat yang dimana bercorak religious,kontan,dan konkrit.kemudian ada juga perkawinan islam.Hukum perkawinan KUHPer berlaku burgelijk wetwoek,bukti dari pencatatan perkawinan dimasa ini adalah adanya wali dan dua orang saksi. Ditetapkan pada tanggal 2 januari 1974.Undang-undang ini lahir dikarenakan adanya suatu ide yaitu unifikasi hukum dan pembaharuan hokum.Pencatatan perkawinan sangat diperlukan bagi pihak yang melangsungkan pernikahan sebagai dasar perlindungan negara terhadap pihak dalam pernikahan.
