Sebenarnya sebelum orde baru terdapat undang-undang yang bagus sebagai undang-undang payung di sektor agrari yaitu UUPA-1960. Dalam undang-undang tersebut menetapkan batas-batas luas maksimum dan batas luas minimum serta mengatur pemanfaatan sumber daya alam. Akan tetapi undang-undang tersebut tidak diaplikasikan dengan baik sehingga timbul permasalahan yang ada. Kalaupun diaplikasikan itu hanya pada tingkat pedesaan dan bukan pada obyek seharusnya.

LAND REFORM IS A SOLUTION FOR AGRARIAN PROBLEM


Do you remember with the koes plus song entitled “kolam susu?” in some of the lyrics mention that Indonesian soil is very fertile soil. The lyrics do not lie, because Indonesia is located in the tropics with high rainfall so that the process of rock weathering be perfect. Therefore, in addition to well-known as a maritime country, Indonesia is also known as an agricultural country where the majority of people living as farmers.

In the new order there is a special program for Agrari aspects with called green revolution. Modernization policy when it changed the pattern of subsistence agriculture into commercial agriculture and capital-based. Because of the changing pattern performed to support the commercial so establish development of the modern economic system, development national fertilizer factory and establish “village unit cooperative” or in bahasa Koprasi Unit Desa (KUD).

Although there are positive effects occur such as increased employment but the negative impacts are felt. Social gap between poor farmers and wealthy farmers increasingly visible and deliberate economy of the existence of poverty,  high crime, and juvenile delinquency.

Today is exactly 69 years of Indonesian independence and the new order was already passed into the reform period. But whether the government program for Agrari aspect is getting better?

In this year, the Food and Agriculture Organization (FAO) estimates that Indonesia will import rice as much as 70% of the 705 880 tonnes imported last year.

Quote from berdikarionline.com, Friday (20/06/2014) lecturer of agraria law in Juanda University, Sudri Heryana revealed that Indonesia is still struggling to overlap Agrari law. "Harmonization is necessary, because a lot of Sectoral laws (UU) that conflict with UUPA 1960," he explained.
