The Term of Maqasid Shariah

The term Maqasid Shariah originated from the two words they are Maqsad or Maqsid and the te Shariah. The term Maqsad or Maqsid is an Arabic word that refers to "objective, wisdom, intent or purpose". The word Maqsad or Maqsid is combined with the term Shariah to literally mean "path" "way" or "a path to a watering place"; it also means "Islamic law". However, in its collective application, the word "Shariah" is regarded as strict submission to Allah's instructions, guidance and principles that have addressed man kind on matters that relate to their behaviour in this world and salvation in the next.

Maqasid Shariah is considered as the preservation of the basic elements that are associated with a human being (Jalil, 2006). According to Auda (2010), theword Maqasid Shari'ah is a signicant technique and an intellectual apparatus for Islamic reform.  

Maqasid Shariah presents to create adavantages both in the world and in the hereafter on the basis of Al-Quran and Hadist.

The purpose of Maqasid shariah is to reach people's welfare. In achieving people's welfare it can be done through Maqasid Shariah, which is protection of :

  • Religion (Diin)
  • Soul (Nafs)
  • Intellect (Aql)
  • Generation (Nasb)
  • Wealth (Maal)

Maqasid Shariah of Islamic Economic

Maqasid Shariah of Islamic Economic is the shariah purpose or target that can reach the human benefit in the world and hereafter in economic sector.

Application of Maqasid Shariah in Economic Sector are :

  • Maqasid Shariah in Islamic economy
  • Maqasid Shariah inIslamic banking
  • Maqasid Shari'ah inIslamic nance
  • Maqasid Shariah in Islamic nancing product
  • Maqasid Shariah in economic development

Factors that can motivate Maqasid Shariah Practice :

  • The need for more extensive research about Maqasid Shariah Science, because it can help to addressing any obstacle that hinder the development of Moslem world
  • Require to the realization of justice and equality
  • There are moral and educated citizens to realize Maqasid Shariah in economy development
  • Government Support in Maqasid Shariah implementation, so everything can be done more easily.

Factors that can inhibit Maqasid Shariah Practice :

  • The lack of effective knowledge about Maqasid Shariah and there are still few of them who expert in Maqasid Shariah
  • The lack of public awareness about the importance of Maqasid Shariah
  • There are still lots of people who don't really understand about what Maqasid Shariah is
  • There is still a lack of implementation on Maqasid Shariah in several sector, such as Entrepreneurship Development, Investment, Islamic Principles of Equality and Other Social, and Economic and Financial Development.

Implementation of Maqasid Shariah in Islamic Bank.

Islamic Banks to replace Conventional Banks. With Islamic Banks can eliminate the usury in the banking world, which will be replaced by sharing profit. With the sharing profit, the customer's assets are covered by illicit assets, because the Islamic bank tries to maintain and allocate customer funds properly and rightfully. Islamic banks can also maintain the soul to respect each other and keep the mandate given, through the contracts that are implemented. Islamic Banks can also guard ourselves and our mind not to easily abuse and deceive each other by explaining bank products in detail without covered up.

Maqasid Shariah is also so much needed in banking regulation making. With the Maqasid Shariah approach, Islamic Bank products can develop well and can response the business progress. Maqasid Sharia will also make Islamic Banks grow faster and create new products creatively.

Without Maqasid Shariah Islamic Banks, it will be difficult and slow to develop, the supervisors easily blame the truth when auditing Islamic Banks, and regulators will be easy to reject innovative products that are in accordance with Shariah.
