Human Right: Sakhil Afridi’s Right as Human

The Jakarta post news paper’s article on May 24, 2012, under the title “Pakistan convicts doctor who helped find bin Laden "Pakistan convicts doctor who helped find bin laden” stated that doctor Sakhil Afridi worked for CIA in finding Osama.Afridi is now sentenced 33 years by Pakistani customary law and jailed in Peshwar, Pakistan. Of course it makes many elements keep asking why does, he jailed? He has right to do what he wants, right?

Dr. Afridi graduated from the Khyber Medical College, Peshwar, 1990 and comes from a humble background. He had been working as the doctor in-charge of Khyber Agency of the Federally Administered Tribal Areas of Pakistan. He is a native of Khyber Agency. In July 2011, Dr. Afridi was described as being in his late 40s.

Exactly, Afridi is a forensic doctor in Khyber. As a forensic doctor, he collect DNA and immunize the society. His background work and the dead location of Osama bin Laden at Abattabad issued that he work for USA. Abattabad is a smaller area in Khyber, Pakistan. Thus, make Al-Qaeda pointed him as a betrayer and helped CIA in finding Osama bin Laden, the leader of Al-Qaeda.

Afridi case might not appropriate with one of articles in human right rules that have been agreed by most countries in United Nation conference. The articles declare that everyone has the right to life, liberty and security of person (article 3); No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment (article 5).

Afridi is called betrayer for his country because he helped CIA to found Osama bin Laden. However, most of the people want Pakistan’s court investigates this case deeply. There might be some reasons that why Afridi did it. In addition on this, transparancy from the court could make the society know and understand about the reason of Afridi's case. Perhaps, some people think that: is the relation between Afridi’s profile with the location as a doctor of Osama was trapped? It might be he just did his duty as a doctor to inquiry Osama’s DNA. Everyone, as a member of society, has the right to social security and is entitled to realization, through national effort and international co-operation and in accordance with the organization and resources of each State, of the economic, social and cultural rights indispensable for his dignity and the free development of his personality (article 22).

There ought to be a clearer reason, so it could make the society understand about the “utilizing” of human right rules, although Afridi has to be jailed. The human right rules sometime give contribution for the “people’s confusion”, such as conjoined twins baby in Egypt. The doctor was confused to separate them, because she did not want break the human right rules. She was afraid if the babies could not be saved, but she should help the babies and their family. Perhaps, there are many cases about that confusion in this world. Human rights’ rules are used by the court, government, and large society to get their rights, but it does in particular time. Consequently, there is a question; is the human right rule doubted?
