On April 27, 2024, Corrections will reach its 60th year, and is commemorated as Hari Bhakti Pemasyarakatan (HBP). The concept of Corrections was officially used to replace the concept of prison after the Djawatan Kependjaraan Conference in Lembang, Bandung on April 27, 1964. Corrections seeks to foster and guide prisoners so that they can realize their mistakes, not repeat their actions so that they can be accepted by the community and live reasonably as good, law-abiding, and responsible citizens.
The 60th HBP commemoration carries the theme "Pemasyarakatan PASTI Berdampak". This theme intends to emphasize the commitment to provide the best service to the public by prioritizing the values of professionalism, accountability, synergy, transparency, and innovation (which are the same as the values of the Ministry of Law and Human Rights) and have an impact on the entire community. Public services to members of the community, namely detainees and prisoners, are based on the provisions of Law Number 22 of 2022 concerning Corrections, Law Number 25 of 2009 concerning Public Services and other binding regulations. Public services can be in the form of services to carry out worship in accordance with their religion or belief, health services and proper food, visitation services from family and other parties, as well as services to provide remission, assimilation, and parole for those who have met the provisions such as good behavior, actively participating in coaching programs, and have shown a decrease in the level of risk (see Article 10 paragraph 2 of Law Number 22 of 2022 concerning Corrections).
The theme of the 60th HBP, namely "Pemasyarakatan PASTI Berdampak" can be further optimized for the implementation of Corrections through the stipulation of implementing regulations as instructed by the provisions of Article 98 of Law Number 22 of 2022 concerning Corrections which reads in full "The implementing regulations of this Law must be stipulated no later than 1 (one) year from the enactment of this Law", while this Law has been enacted on August 3, 2022.Â
Law No. 22 of 2022 concerning Corrections mandates further arrangements which include: 1. Provisions regarding the terms and procedures for the implementation of the rights and obligations of detainees, children, and prisoners are regulated by Government Regulation (see Article 18); 2. Provisions regarding the organization of detention services shall be regulated by Government Regulation (see Article 27); 3. Provisions regarding the implementation of children's services shall be regulated by Government Regulation (see Article 34); 4.Provisions regarding the implementation of prisoner development shall be regulated by Government Regulation (see Article 41); 5. Provisions regarding the implementation of the guidance of foster children shall be regulated by Government Regulation (see Article 52); 6. Provisions regarding special services or guidance shall be regulated by Government Regulation (see Article 54 paragraph 4); 7. Provisions regarding the implementation of community guidance shall be regulated by Government Regulation (see Article 59); 8. Provisions regarding the care of detainees, children, prisoners, and foster children shall be regulated by Government Regulation (see Article 63); and 9. Provisions regarding the implementation of security and observation shall be regulated by Government Regulation (see Article 80).
