ABSTRACT
Background. Light charges against corruption perpetrators not only damage the legal system, but also have significant social and economic impacts. The phenomenon of light charges indicates injustice in the justice system that can worsen social polarization, increase tensions between society and the government, and damage public participation in sustainable development. This also has the potential to trigger social apathy, economic side, corruption worsens economic instability, inhibits growth, and widens social gaps that directly harm society.
Research Objectives. To examine the effect of light charges on the deterrent effect for corruption perpetrators and the factors that influence the weak prosecution in corruption cases. Light charges have the potential to weaken the deterrent effect, making corruption perpetrators feel unafraid to repeat their actions.
Research Methods. This study uses a qualitative approach with a literature study to analyze the effect of light charges on the deterrent effect for corruption perpetrators, as well as factors that influence weak prosecution in corruption cases.
Results and Discussion.
Factors that influence light prosecution include political intervention, weak capacity of law enforcement agencies, and a culture of corruption rooted in the bureaucracy. These less than optimal demands not only reduce the deterrent effect on corruption perpetrators, but also worsen the social and economic conditions of the community. To overcome this problem, legal reform is needed that strengthens law enforcement agencies, increases firmness in prosecution, and eliminates political intervention that influences legal decisions.
Conclusion.
Light charges against corruption perpetrators in Indonesia are a major problem in eradicating corruption, creating negative perceptions in society. Imbalance in the legal system, which is influenced by political and power factors. Strategic steps are needed, such as improving the justice system, increasing transparency, and ensuring independence in the legal process.
