Menurut Black Law Fourth Edition, Actio Arbitraria adalah "action depending on the discretion of the judge. In this, unless defendant would make amends to plaintiff as dictated by the judge in his discretion, he was liable to be condemned". Dalam Bahasa Indonesia, actio arbiraria dapat diartikan sebagai perbuatan hukum berdasarkan keputusan hakim.
