Qanun Jinayah: A Logical Flaws?

This article refers to my comment on Jakarta post's article on October 6th 2014 entitled "Logical Flaws in Aceh's 'Qanun Jinayat'.http://www.thejakartapost.com/news/2014/10/06/logical-flaws-aceh-s-qanun-jinayat.html

As an Acehnese, I totally disagree with this opinion as the article said there were at least two logical flaws #1 from the early history of Aceh, Islamic values and laws have become a way of life guided by local ulema. #2  the assumption that the formalization of sharia was the central demand of more than three decades of Acehnese struggle.

Historically, Shariah has become the way of Acehnese's life since the beginning. Even before the kingdoms era. The implementation of Sharia and Islamic court has along journey ever since. During the Aceh Kingdoms the Judicial Power held by Qadli Malikul Adli (Supreme Court) in Kingdom's capital. They also have Qadli Uleebalang to handle law in the regions. This is the way of Acehnese to uphold Sharia as the way of Islam life. Definitely not only the way of life guided by local ulama but also the way of Aceh people life guidance since the early time.

In order to preserve our historical journey, we think the way of Aceh life need  to be formalized. The way of sharia. this is not a flaw assumption. There was nothing to do about our three decades of struggle nor MoU that bond us as one whole nation, Indonesia. This is about islamic principals that was long held by our ancestors.

So, is this all about human rights? well, as an Acehnese we have our own version of Human rights. It may be different from the western version but indeed, our version also teach us humanity values and goodness based on our culture and  customs. Not western customs. Its Islamic culture and customs. Absolutely, We could not applied foreign version of human rights into our way of life nor our home.

I think the writer of this article should learned more about our culture and the way we think and see about our history, culture and customs. He/She should not judged our decision by his/her western version.
